TRUE LIFE TOWNHOMES – 612 S MAIN ST – SITE DEVELOPMENT PERMIT NO. SD22-0007, CONDITIONAL USE PERMIT NO. UP22-0003, VESTING TENTATIVE MAP NO. TM22-0003, TREE REMOVAL PERMIT NO. TR22-0014, ENVIRONMENTAL ASSESSMENT NO. EA22-0005, AND DENSITY BONUS PERMIT NO. DB22-0002
Project Description: A Site Development Permit, Conditional Use Permit, Vesting Tentative Map, Tree Removal Permit, Density Bonus Permit, and Environmental Assessment to allow demolition of an existing multi-tenant office building, removal and replacement of 13 ordinance-size trees, and development of 57 townhomes with attached two-car garages. The residential development will consist of nine multi-family residential buildings, up to approximately 37 feet in height (three stories), parking for up to 123 vehicles, and associated site improvements on a 2.35-acre site located in the Mixed Use (MXD) Zoning District at 612 South Main Street. The Project is located within the Midtown Specific Plan Area and submitted under California Senate Bill 330 (Housing Crisis Act of 2019).
At its February 22, 2023 meeting, the Milpitas Planning Commission voted (4 Ayes, 2 Nays, and one absent) to consider the exemptions in accordance with CEQA, and adopt Resolution No. 23-004 recommending that the City Council approve Site Development Permit No. SD22-0007, Conditional Use Permit No. UP22-0003, Vesting Tentative Map MT22-0003, Density Bonus Permit No. DB22-0002, Tree Removal Permit No. TR22-0014 and Environmental Assessment No. EA22-0005, subject to the Conditions of Approval..
The Milpitas Planning Commission at the same public hearing date also independently recommended that the City Council study parking on Main Street and community meetings.
CEQA: The Project is exempt from environmental review under the California Environmental Quality Act pursuant to Sections 15332 and 15168 (Program EIR) of the CEQA Guidelines. The proposed project is covered under the scope of activities previously analyzed in the Midtown Specific Plan Environmental Impact Report (SCH #200092027) certified by the Milpitas City Council in March 2002.
